HOME SOLD REALTY LLC

Last updated: September 28, 2026

This privacy notice for HOME SOLD REALTY LLC (“Company,” “we,” “us,” or “our”) describes how and why we might collect, store, use, and/or share (“process”) your information when you use our services (“Services”), such as when you:

  • Visit floridaflatfeehomes.com, fsbomlslistings.com, or another Company-owned website that links to this notice.
  • Register for a customer account, purchase a listing package, use our dashboard, submit property information or documents, or complete identity verification.
  • Engage with us through property inquiries, calls, texts, email, support, sales, marketing, or events.

Our listing services are provided to sellers, landlords, and their authorized representatives. This notice also addresses information we receive from people inquiring about listed properties. Receiving or forwarding an inquiry does not, by itself, create a brokerage relationship with the inquirer.

Questions or concerns? Reading this privacy notice will help you understand your privacy rights and choices. If you have questions or disagree with a particular processing activity, please contact support@fsbomlslistings.com before submitting the information concerned. Some information is needed to provide a requested service. Reading or accepting this notice is not blanket consent to every processing activity, and does not waive your legal privacy rights.

SUMMARY OF KEY POINTS

This summary provides key points from our privacy notice. Use the section references or table of contents below to review the relevant information in full.

What personal information do we process? When you visit, use, or navigate our Services, we may process personal information depending on how you interact with HOME SOLD REALTY LLC and the Services, the choices you make, and the products and features you use. This includes contact, account, property, document, payment-related, verification, communication, and technical information. See Section 1.

Do we process any sensitive personal information? Yes. Identity verification through Veriff involves government-ID information, ID images, selfies, and facial biometric processing. Other sensitive information may be included in ownership or transaction documents. We process sensitive information with the consent or other legal basis required for the particular activity. See Sections 1, 3, and 7.

Do we receive any information from third parties? We may receive relevant information from public property and business records, MLS systems, verification providers, authorized representatives, property inquirers, transaction professionals, and social platforms when you choose to interact with us there. See Section 1.

How do we process your information? We process your information to provide, improve, and administer our Services, communicate with you, verify identity and authority to list, route property inquiries, prevent fraud, maintain business records, and comply with applicable requirements. We may also process information for other disclosed purposes with the required permission. See Sections 2 and 3.

In what situations and with which types of parties do we share personal information? We use service providers and disclose relevant information to MLS and showing systems, property inquirers, authorized transaction professionals, and other recipients described in this notice. Provider privacy notices supplement our explanation; they do not replace our responsibilities. See Section 4.

Do we use cookies and automated systems? Yes. Both websites use cookies, including Google Analytics cookies. Our Florida website also showed a Meta-associated cookie during our review. We use AI-powered systems for property inquiries and AI tools for listing and administrative work. See Sections 2, 5, and 11.

How do we keep your information safe? We use access restrictions, authentication, and service-provider safeguards. However, no electronic transmission or storage technology can be guaranteed to be completely secure. See Section 8.

What are your rights? Depending on applicable law, you may have rights to access, correct, delete, or obtain a copy of information, withdraw consent, restrict certain processing, or opt out of specified uses. See Sections 10, 12, and 13.

How do you exercise your rights? Contact support@fsbomlslistings.com, use the support widget in your customer dashboard, or write to the address in Section 15. An active customer account is not required to email or mail a request. We consider requests under applicable law. See Section 16.

1. WHAT INFORMATION DO WE COLLECT?

Personal information you disclose to us

In Short: We collect personal information that you provide to us, including information needed to provide listing services and verify identity and authority.

We collect personal information that you voluntarily provide to us when you register on the Services, express an interest in obtaining information about us or our products and Services, participate in activities on the Services, or otherwise contact us.

Personal Information Provided by You. The personal information we collect depends on the context of your interactions with us and the Services, the choices you make, and the products and features you use. It may include:

  • Names, phone numbers, email addresses, mailing addresses, and contact preferences.
  • Usernames, passwords or other authentication information, and account settings.
  • Billing addresses, order details, payment status, and transaction references.
  • Property addresses, parcel information, property descriptions, photographs, listing instructions, and designated listing-contact information.
  • Listing agreements, disclosures, signatures, and documents establishing ownership or authority to act.
  • Identity-verification information described below.
  • Information in property inquiries, support requests, emails, texts, and other communications.

Sensitive Information. When necessary, with your consent or as otherwise permitted by applicable law, we process sensitive information relevant to a specified purpose. This can include government identifiers and identity-document information, facial biometric information, account credentials, and financial information contained in documents or payment workflows. Not every record or document has the same legal classification.

Social Security numbers or other sensitive identifiers should be provided only when specifically needed for a disclosed, lawful purpose through an appropriate secure process. Do not include unnecessary Social Security numbers, financial account details, or other sensitive information in property descriptions or ordinary communications. Government-issued documents may contain other protected or sensitive details that are incidental to identity verification; we do not request those details for advertising or tenant selection.

Payment Data. Payment transactions are processed through Stripe and, for some purchases, PayPal. Their payment flows may require a payment instrument number, security code, billing address, or other payment information. We receive purchase, payment-status, and transaction-reference information needed to administer orders, refunds, and accounting. This notice does not promise that every payment-related record is stored exclusively by one provider. Review the Stripe Privacy Policy and PayPal Privacy Statement for their processing. Do not send payment credentials through ordinary email, text, or support messages.

Social Media Login Data. Where offered, you may be able to register or log in using an existing third-party account, such as Facebook or another social account. If you choose that option, we receive the information described in Section 6 and in the provider’s authorization screen. The availability of an optional login method is not a statement that every website offers it.

All personal information that you provide to us must be true, complete, and accurate, and you must notify us of relevant changes. Provide another person’s private information only when you have appropriate authority.

Property ownership and corporate documentation

Public Records. We obtain relevant property information from public records, such as deeds, tax records, property cards, and parcel records, and may compare it with information you provide. Public-record research and identity verification are separate steps.

Ownership and Authority Documents. You may be required to provide a deed, trust or estate documentation, power of attorney, corporate records, or other evidence establishing authority to list. Ownership documents are submitted through our Propzu/DocuSign document workflow, not as the ownership-document component of Veriff verification. Authorized Propzu personnel may access documents stored in Propzu. CTMe Contracts is used for Colorado documents and electronic signatures.

Corporate Identification. For property held by a business or other entity, documentation may include state registration information, articles of incorporation or organization, evidence of authorized representatives, and relevant tax-identification documentation. Submit only the portions necessary for the stated purpose, unless an unredacted document is lawfully required.

Identity verification through Veriff

We use Veriff through our direct Company account to help verify the identity of individuals requesting listing services and reduce unauthorized or fraudulent listings. The website verification form requests the individual’s name and property address before starting the Veriff process.

Verification involves government-ID information and images, selfies, and facial biometric processing. The tested document flow also requests front and back images and barcode information. Session audio and video may be recorded as disclosed by Veriff in the verification flow. Relevant device, session, and verification-result information is also processed.

The broker reviews verification information through Veriff Station. Our routine practice is not to download customers’ Veriff ID images, selfies, or session recordings to local computers. This does not mean that no verification-related information exists elsewhere in our systems.

Internal Verification Notifications. Limited result notifications go through HighLevel/GHL and to the broker’s phone for internal verification and listing administration. They may contain the individual’s name, property address, status, timestamp, and session reference. They do not contain ID images or selfies and are not sent by email, to customers, or to property inquirers or referral partners. The customer sees an on-screen verification-status message.

Notice and Consent. Before proceeding, review Veriff’s Privacy Notice, its End User Terms, and the notices presented during verification. The collection and use of biometric information require the permission or other legal basis applicable to that processing. General acceptance of this notice or a device’s camera/microphone permission is not a substitute for any separately required biometric consent.

Declining Verification or Experiencing Difficulties. We require identity and authority to be adequately verified before activating a listing. We offer Zoom or FaceTime review for technical difficulties and address alternatives or accommodations required by applicable law. We do not record, take screenshots of, or transcribe those alternative calls, and do not routinely keep separate written verification notes; once verification is complete, we continue the listing process. Contact our privacy email about consent concerns, correction, withdrawal, or review. We do not refuse service solely for declining biometric processing where doing so is prohibited by law.

Veriff verifies identity; it does not establish legal title or every person’s authority to act for an owner, trust, estate, or business. We separately review ownership and authorization documents. An unsuccessful verification alone does not establish fraud, and an approved verification does not guarantee that fraud cannot occur. See Section 7 for retention and deletion and Section 10 for choices.

Communications and information from discontinued services

We receive names, contact details, property references, messages, and other information supplied by customers and property inquirers. Our call-handling systems record and transcribe calls as described in Section 2. Call transcripts are also forwarded to a separate business-use Gmail mailbox. Those emailed transcripts are distinct from internal Veriff notifications, which are not emailed.

Tenant-screening services through SARMA have been discontinued. We do not process new rental applications or provide tenant credit or background screening. Any remaining historical applications, creditworthiness or screening information, or related records are subject to applicable security, retention, disclosure, and deletion requirements. Discontinuation does not itself establish that historical records have been deleted.

Information automatically collected

In Short: Some information, such as your IP address and browser or device characteristics, is collected automatically when you visit our Services.

We automatically collect certain information when you visit, use, or navigate the Services. This may include device and usage information such as your IP address, browser and device characteristics, operating system, language preferences, referring URLs, device name, country, approximate location, information about how and when you use the Services, and other technical information. These details can be personal information when linked or reasonably linkable to you or your device. They support security, operation, analytics, and other purposes described in this notice.

Like many businesses, we also collect information through cookies and similar technologies. See Section 5.

  • Log and Usage Data. Service-related, diagnostic, usage, and performance information recorded when you access or use the Services. Depending on the interaction, logs may include IP addresses, device information, browser settings, date/time stamps, pages or files viewed, searches, features used, system activity, error reports, and hardware settings.
  • Device Data. Information about your computer, phone, tablet, or other device, such as IP address or proxy information, device and application identifiers, browser type, hardware model, operating system, internet service provider or mobile carrier, and system configuration.
  • Location Data. Approximate location, such as city, region, or country, may be inferred from an IP address. A property address you submit is separate from your device’s location. This notice does not represent that our websites routinely obtain precise GPS location. Any precise device-location collection would need to be disclosed and handled under the permissions and legal requirements applicable to that feature.

Information collected from other sources

In Short: We may receive limited information from public databases, verification services, social platforms, and other sources relevant to the Services.

We obtain relevant information from public property and business records, MLS systems, authorized representatives, property inquirers, transaction professionals, and providers assisting with verification. Whitepages and FOREWARN support additional phone and identity checks. Such information can include names, contact details, ownership or business-registration information, property records, and identity or verification results.

If you interact with us through a social platform, information we receive depends on your interaction and that platform’s settings. It may include your name, contact or profile information, and messages you send. This does not mean we automatically obtain your contacts, friends list, or every item on your social account.

Information from a marketing partner, affiliate program, or other outside source is used only for a disclosed and lawful purpose where such an arrangement actually applies. This notice does not state that we routinely purchase marketing profiles or receive every category of information available from data providers.

2. HOW DO WE PROCESS YOUR INFORMATION?

In Short: We process your information to provide, improve, and administer our Services, communicate with you, protect against fraud, and comply with law. Other processing requires an appropriate legal basis and, where required, your consent.

We process your personal information for a variety of reasons, depending on how you interact with our Services, including:

  • To facilitate account creation and authentication and otherwise manage user accounts. We may process your information so you can create and log in to your account, and to keep your account in working order.
  • To deliver and facilitate delivery of services to the user. We process relevant information to prepare, publish, and manage listings and provide the services you request.
  • To respond to user inquiries and offer support. We process written support requests and related information to address issues with the Services. Customer technical support is separate from a broker consultation.
  • To send administrative information to you. We may send information about orders, verification, listings, changes to terms or policies, and other service matters.
  • To fulfill and manage your orders. We use information to administer orders, payments, physical items, refunds, returns, and exchanges where applicable.
  • To enable user-to-user communications. We exchange designated seller/landlord contact information and property-inquirer information to support direct communication about the listed property.
  • To protect our Services. We process information for security, identity and authority checks, fraud monitoring, and prevention of unauthorized listings or use.
  • To save or protect an individual’s vital interest. Where applicable law permits, we may process information necessary to protect an individual’s vital interests, such as to prevent serious harm.
  • To verify ownership of real estate and authority to list. We compare relevant information with public property records and review documents establishing ownership or authorization. This is separate from identifying the individual through Veriff.
  • To maintain records and comply with requirements. We retain relevant business and transaction records, address lawful requests, meet applicable MLS or regulatory requirements, and establish, exercise, or defend legal claims.
  • To understand and improve our Services and send permitted promotions. We use relevant usage information and may communicate offers, newsletters, or event information where permitted. Marketing choices are described in Section 10.

AI-assisted property inquiries and recorded calls

AI-powered and automated systems, rather than live receptionists, handle property inquiries through calls, texts, and email. They request information identifying a specific property, obtain contact details, and route inquiries or contact information between interested parties and the seller or landlord. This processing supports the listing service; it does not authorize unrelated solicitation or tenant-screening decisions by us.

Automated Message Classification. We use AI-powered systems to analyze the content of text and email inquiries and classify their apparent purpose to determine whether they are automatically forwarded to the seller or landlord. Messages identified as vendor solicitations may be excluded from automatic forwarding. Classification does not verify the sender’s identity or actual intentions and may be incorrect. A message appearing to concern a property may be forwarded, and the seller’s or landlord’s designated contact information may be provided to the inquirer, without independent verification of that person.

HighLevel/GHL supports our calling, messaging, email, recording, and transcription workflows. Incoming calls carry a recording announcement. Recordings and transcripts may include the caller’s voice, contact information, property reference, and conversation. Required notice and any required consent must precede the regulated collection or processing; a seller’s agreement to use our Services does not provide the caller’s consent.

AI property-inquiry call transcripts are also sent to a business-use Gmail mailbox, creating a separate copy. Company-user access to that mailbox is limited to the broker. General email communications also use Google Workspace. Questions or objections about recording, incorrect routing, or communications may be sent to our privacy email. Do not provide ID images, verification selfies, or unnecessary payment information through inquiry channels.

AI-assisted listing and administrative work

We use OpenAI ChatGPT and Codex for tasks such as listing preparation, MLS input, and related administrative work. Information supplied for those tasks through text, documents, messages, or accessible screens may be processed through those tools. We do not represent that every AI product or account uses identical retention or model-improvement settings. Relevant provider information is linked in Section 4; the Company’s purposes and disclosures are described in this notice.

3. WHAT LEGAL BASES DO WE RELY ON TO PROCESS YOUR PERSONAL INFORMATION?

In Short: We process personal information when we have a valid legal basis under applicable law, such as consent, contractual necessity, legal obligations, or an appropriate legitimate interest.

If you are located in the EEA or UK

Where the General Data Protection Regulation (GDPR) or UK GDPR applies, we rely on a legal basis appropriate to the activity:

  • Consent. We may process personal information for a specified purpose when you give permission. You may withdraw consent as explained in Section 10.
  • Performance of a Contract. We may process information necessary to fulfill contractual obligations or take steps at your request before entering a contract, including providing the Services you request.
  • Legitimate Interests. We may process information where reasonably necessary for legitimate business interests and those interests are not overridden by your interests or fundamental rights and freedoms. Examples include proportionate security measures, diagnosing problems, fraud prevention, and checking authority to list property.
  • Legal Obligations. We may process information where necessary to comply with legal obligations, respond to lawful regulatory or law-enforcement requirements, and maintain required records. Establishing or defending claims may involve another appropriate legal basis depending on the activity.
  • Vital Interests. We may process information where necessary to protect your vital interests or those of another person, such as a serious threat to safety.

Sensitive and Biometric Information. Where biometric information is used to uniquely identify an individual and special-category rules apply, processing also requires an applicable special-category condition, such as explicit consent. A contractual need or ordinary legitimate interest alone does not replace that condition. The particular notices and permissions must relate to the processing actually performed.

If you are located in Canada

Where applicable Canadian privacy law requires consent, we process information with the type of permission appropriate to the circumstances and sensitivity of the information. This may be express consent or, where lawfully appropriate, implied consent. You may withdraw consent as described in Section 10, subject to applicable legal or contractual restrictions and reasonable notice where permitted.

In exceptional cases, applicable Canadian law may permit collection, use, or disclosure without knowledge or consent. The following examples describe possible statutory exceptions, not additional routine activities of Home Sold Realty. Each applies only when its legal conditions are met:

  • Collection clearly in an individual’s interests where consent cannot be obtained in a timely way.
  • Investigation of a breach of an agreement or contravention of law, or fraud detection and prevention, where obtaining consent would compromise the activity and other statutory conditions are satisfied.
  • A business transaction subject to the required agreements, necessity, safeguards, and notification conditions.
  • Information in a witness statement needed to assess, process, or settle an insurance claim.
  • Identifying an injured, ill, or deceased individual and communicating with appropriate next of kin or representatives.
  • A suspected case of financial abuse where the statutory conditions for disclosure without consent apply.
  • Compliance with a subpoena, warrant, court order, or other lawful production requirement.
  • Information produced in the course of an individual’s employment, business, or profession where collection or use is consistent with its original purpose, as permitted by law.
  • Solely journalistic, artistic, or literary purposes where the applicable exception applies.
  • Publicly available information of a kind specified by applicable regulations and used consistently with those rules.

Other jurisdictions and international processing

Other laws may require consent or impose additional restrictions on sensitive information, biometric processing, marketing, or automated decisions. We apply the requirements relevant to the individual, information, and activity, including any applicable exemptions. Listing a property in one state does not, by itself, determine every privacy law applicable to a person.

We operate in the United States and use providers that may process information in other countries. We do not represent that every record remains in the United States. Where required, international transfers must use an appropriate transfer mechanism or other lawful basis. Contact us for information about safeguards relevant to your information.

4. WHEN AND WITH WHOM DO WE SHARE YOUR PERSONAL INFORMATION?

In Short: We share relevant information in the situations and with the categories of recipients described here. We do not give every provider every category of information.

Vendors, consultants, and other third-party service providers

We use third-party providers, contractors, and agents to perform services needed to operate our business. Where a provider processes information on our behalf, that processing is subject to appropriate instructions and contractual safeguards required by applicable law. Some providers also process information for their own separately lawful purposes or use authorized subprocessors. We do not promise that every provider’s processing is identical or that it can never disclose information to another authorized recipient.

Our principal providers and categories include:

  • Hosting, dashboard, technical support, and document management: SiteGround, Propzu, DocuSign, and CTMe Contracts, with CTMe used for Colorado documents and signatures.
  • Payments and associated order/accounting records: Stripe and PayPal.
  • Calls, texts, email, CRM, and automated communications: HighLevel/GHL and Google services, including Gmail and Google Workspace.
  • Identity, phone, and fraud-related checks: Veriff, Whitepages, and FOREWARN. Alternative video review uses Zoom or Apple FaceTime.
  • AI-assisted listing and administrative work: OpenAI tools described in Section 2.
  • Property publication, showings, and transactions: Applicable MLS systems, showing-scheduling systems, and authorized transaction professionals. The systems and recipients depend on the property’s location and requested service.
  • Analytics, advertising-related tools, and embedded content: Relevant providers described in Section 5, including Google and, on the Florida website, Meta-associated tools.

Provider names linked above lead to their published privacy notices. Please review those notices and any terms or notices presented during use for the provider’s own practices. These links supplement our disclosures; they do not transfer Home Sold Realty’s responsibilities or authorize undisclosed new uses by us. Contact us for details about a relevant provider whose notice is not linked here.

Additional sharing situations

Business Transfers. We may share or transfer relevant information in connection with, or during negotiations concerning, a merger, sale of company assets, financing, or acquisition of all or a portion of our business, subject to applicable legal restrictions and safeguards.

Google Maps and Embedded Tools. Where our Services display maps or use Google Maps Platform features, those features may process information necessary to deliver the requested content, including technical information or a search location. Review Google’s Privacy Policy. The availability of a map does not establish that we collect a visitor’s precise GPS location.

Affiliates. We may share information with affiliated businesses when necessary for an authorized service or another disclosed, lawful purpose. Affiliates include companies under common ownership or control. We require appropriate protections where applicable; this is not blanket permission for an affiliate to use verification data or customer contact information for unrelated advertising.

Business Partners and Requested Referrals. If a customer requests service outside our area, we may provide a local broker’s contact information and, after the customer’s permission, share relevant information with that broker. This is not automatic distribution of customer information to referral partners. Information disclosed to a title company, attorney, lender, or other professional is limited to the authorized or otherwise lawful transaction purpose.

MLS Listings and Public Property Information. Listing details and media are provided to the applicable MLS and may be displayed through Company Sites, MLS feeds, IDX websites, and third-party property platforms. Those platforms may combine listing information with public records or other sources and maintain independent property histories. Home Sold Realty does not operate those sites or guarantee their removal of independently retained information. We still address lawful requests concerning information under our control and take required steps regarding recipients.

Designated Seller/Landlord Contact Details. Information you select for contact purposes may appear on Company-owned listing pages and in MLS private remarks or showing systems where permitted. We do not place those contact details in MLS public remarks or supply them as public-facing owner-contact content to third-party listing websites. We share designated details with people or entities inquiring about your property, including buyers, tenants, agents, title companies, and lenders, and forward their supplied information to you. This is part of delivering property inquiries. We do not intentionally distribute your designated contact information to vendors for unrelated solicitation. However, because property inquirers are not independently authenticated, we cannot guarantee that a person requesting property information will use the contact details solely for that purpose.

Other Users and Public Areas. When you post comments, contributions, profile details, or other content in public areas of the Services, where those features are available, other people may view, copy, or use that information. Social-platform visibility depends on the feature and permissions you select. We cannot guarantee removal of every independent copy of voluntarily published material. This paragraph does not authorize public disclosure of private verification media or transaction documents.

Legal, Safety, and Security Reasons. We may disclose relevant information where lawfully required or permitted to comply with legal process, investigate fraud or security incidents, protect rights or safety, or establish, exercise, or defend legal claims. Disclosure of sensitive information remains subject to its applicable restrictions.

Verification Information Is Separate. We do not publish ID images, verification selfies, or biometric information in listings, give them to property inquirers, or use them for advertising. We do not sell, lease, or trade biometric identifiers or biometric information. Limited internal notification handling is described in Section 1. Veriff processes verification on our behalf and separately describes certain processing it performs for its own lawful purposes in its notice. Ordinary contact-sharing permissions do not override special protections for biometric information.

5. DO WE USE COOKIES AND OTHER TRACKING TECHNOLOGIES?

In Short: Yes. Both websites use session and Google Analytics cookies. The Florida website also uses a Meta-associated cookie.

Cookies are small data files stored by your browser. Similar tools, including pixels, scripts, and local storage, can support website functions or transmit technical and usage information. A tool can transmit information without storing a cookie.

Both Company websites use Google Analytics cookies, including _ga and a property-specific _ga_... cookie, and a PHPSESSID session cookie. Google Analytics uses these cookies to distinguish visitors and maintain session information. The Florida website also uses _fbp, a Meta-associated cookie. Additional cookies or related technologies may operate when you use particular features or embedded services.

We use website technologies for operation, account or session functions, preferences, security, usage analysis, and, where enabled, advertising measurement or related marketing functions. Relevant information may include browser or device details, cookie or similar identifiers, pages visited, interactions, and approximate location. Provider descriptions are available through Google’s privacy information and Meta’s cookie policy.

Our websites currently do not display a cookie Accept/Reject or preferences banner. Browser settings can block or delete cookies, but may affect website features and do not necessarily prevent all non-cookie data collection. Contact support@fsbomlslistings.com about cookies or to exercise applicable privacy rights. Browser controls and an email request do not replace any website consent or opt-out method required by applicable law.

Analytics and advertising-related providers may receive the online identifiers and technical or usage information described above. Applicable privacy rights, including rights concerning sale, sharing, or targeted advertising, are explained in Sections 10–13. We do not treat the absence of a cash payment or our practice of not distributing contact lists to unrelated vendors as proof that no legally defined sale or sharing occurs. A separate Cookie Notice, when provided, supplements this notice.

6. HOW DO WE HANDLE YOUR SOCIAL LOGINS?

In Short: If you choose an available social-account registration or login option, we may receive certain information from that provider.

Where the Services offer registration or login through a third-party social account, we receive the profile information authorized for that feature. This often includes a name, email address, profile picture, or account identifier. Additional information, such as contacts or a friends list, is received only if the feature requests it and the provider’s permissions allow it; it is not obtained automatically merely because you visit our website. We do not receive your third-party account password through that login feature.

We use information received through social login only for the purposes described in this notice or otherwise explained when the feature is used. The provider’s own handling of your information is governed by its privacy notice and settings. Please review those materials to understand what is shared and how to manage your preferences or disconnect access.

7. HOW LONG DO WE KEEP YOUR INFORMATION?

In Short: Retention depends on the information and purpose. Brokerage documents, verification materials, and communications do not all have the same retention period.

Our retention policy is to keep personal information only for the period reasonably necessary for its disclosed purpose, subject to applicable minimum recordkeeping periods, earlier destruction requirements, and legal holds. The criteria for the categories below include whether a service or transaction is ongoing, whether a record is required by law, and whether it remains necessary for a specific unresolved inquiry, security matter, or legal claim. The mere availability of storage does not justify retaining information indefinitely.

Brokerage and ownership records

We retain ownership and transaction documents, including listing agreements and disclosures, for at least five years from the applicable legal starting event, and longer when required. For Florida brokerage records, that period runs from receipt of entrusted funds or, when none are entrusted, execution by any party of an agreement engaging the broker. Records involved in litigation require retention for at least two years after conclusion of the civil action or appellate proceeding, whichever is later, and never less than the underlying five-year minimum. Other applicable state requirements and lawful holds may differ.

This brokerage-record minimum is not a blanket instruction to retain every biometric template, selfie, or unrelated inquiry for five years.

Verification information and biometric retention

Veriff has described a 90-day active-storage period for verification records, a maximum of three years for facial biometric information, and encrypted backups that may persist for up to 90 days after deletion from the live service. These are different storage layers. The end of active access is not a promise that every category has been permanently deleted.

Active access, total storage, and backup retention are different. Retention after active storage depends on the applicable Veriff service arrangement, the category of information, and lawful retention requirements. The stated 90-day active period is not a total or permanent-deletion deadline. The reported biometric maximum does not override an earlier purpose-based or legal destruction requirement. Contact support@fsbomlslistings.com for information about a particular verification or to request deletion.

Where Illinois biometric law applies, the relevant destruction requirement is the earlier of satisfaction of the initial collection purpose or three years after the individual’s last interaction with the private entity, subject to lawful exceptions. Where Colorado’s biometric provisions apply, relevant deadlines include the earliest of purpose completion, 24 months after the last interaction, or the reasonably feasible deletion date within 45 days after an annual review determines retention is unnecessary, inadequate, or irrelevant, subject to the permitted extension. Other applicable laws may require earlier action.

Home Sold Realty handles requests concerning verification carried out on its behalf and coordinates required deletion with Veriff using the relevant session reference. You do not need access to our Station account to make a request. Veriff’s own independently controlled processing is described in its privacy notice and addressed through its privacy contact. Legal retention of a listing agreement does not automatically justify keeping associated facial templates or verification media.

Communications, account information, and other copies

Emails, text messages, and transcripts currently remain in GHL and Company email systems, including the business-use Gmail transcript mailbox, without routine automatic expiration. Internal verification-result notifications also exist on the broker’s phone. These copies are separate from Veriff’s underlying session records and must be considered separately when addressing a privacy request. Call-audio retention is not necessarily the same as the retention of an emailed transcript.

For account and authentication records, retention relates to maintaining the account and resolving outstanding orders, access issues, or disputes; required transaction records are retained separately after account closure. For inquiry messages, support correspondence, call audio, and transcripts, the relevant purpose is handling the inquiry or service and documenting an associated transaction, complaint, or dispute. Information that is part of a required brokerage record follows the applicable brokerage-record period. Technical and security logs are retained for operation, troubleshooting, security, and specific incident investigations. These criteria do not represent an automatic deletion timer or a confirmed call-audio storage period.

Historical SARMA screening records, if any remain, are separate from current owner verification. Their retention is limited by the original screening purpose and applicable recordkeeping, dispute, and disposal requirements. Ending tenant-screening services does not itself establish that records held by the Company or SARMA have been deleted.

Alternative Zoom/FaceTime identity checks do not generate Company recordings, screenshots, transcripts, or routine separate written verification notes. Ordinary scheduling or account communications, if any, remain distinct from recording the video check itself.

Deletion, anonymization, and backups

Our retention policy calls for deletion or anonymization when the relevant purpose and any required retention or lawful hold have ended. We have not implemented a universal automatic purge across all Company systems. Where immediate removal from a backup is not technically possible, the information must remain protected and must not be used for an incompatible purpose while awaiting permitted deletion. Backup arrangements do not override binding destruction requirements.

Deletion requests may be subject to lawful exceptions for required records, claims, or preservation. We assess relevant Company systems and provider copies, explain applicable exceptions, and take required steps with providers. Account termination does not automatically erase legally retained transaction records or independent public listing histories. See Sections 10, 12, 13, and 16.

8. HOW DO WE KEEP YOUR INFORMATION SAFE?

In Short: We aim to protect personal information through appropriate organizational and technical measures.

We use access restrictions, authentication, and provider safeguards designed to protect the information we process. Company-user access to Veriff Station and the Gmail mailbox receiving AI call transcripts is limited to the broker; two-step verification is enabled for both accounts. Authorized Propzu personnel may access documents stored in Propzu. These statements do not imply that only the broker can access every provider system or that every provider has identical controls.

However, despite safeguards and efforts to secure information, no electronic transmission over the internet or information-storage technology can be guaranteed to be completely secure. We cannot promise that unauthorized parties will never defeat security measures or improperly access, collect, alter, or disclose information. This limitation does not waive legal rights or remove our security, incident-response, or notification obligations.

Use a secure environment and protect your account credentials. Do not send government-ID images, verification selfies, full payment credentials, or other unnecessary sensitive information through ordinary email, text, or the support widget. Notify support@fsbomlslistings.com about suspected unauthorized access without including unnecessary sensitive records. Suspected incidents and any required notices must be handled in accordance with applicable law.

9. DO WE COLLECT INFORMATION FROM MINORS?

In Short: Our listing accounts and services are intended for adults aged 18 or older. We do not knowingly solicit children’s information or market to children.

Persons under 18 are not permitted to register for our listing services. A parent’s general permission does not create an exception to that age restriction. We do not knowingly solicit identity-verification submissions from children.

If we learn that an underage person has created an account or that a child’s information has been collected without an appropriate lawful basis, we take reasonable steps to address it, including deactivating an ineligible account and deleting information where required. Information lawfully included in an estate, ownership, or other transaction document must be handled according to its purpose and applicable protections, not used to market to a child.

If you become aware of information we may have collected from a child, contact support@fsbomlslistings.com. Any applicable removal rights are preserved, including those discussed in Section 12.

10. WHAT ARE YOUR PRIVACY RIGHTS?

In Short: Depending on applicable law, you may have rights concerning your personal information. You may contact us about your account, consent, communications, and privacy choices.

In some regions, including the EEA, UK, Switzerland, and Canada where their laws apply, rights may include access and a copy, rectification, erasure, restriction, portability, and objection to certain processing. U.S. state laws may provide similar rights, including opt-outs of sale, specified advertising uses, or certain consequential profiling. Rights depend on coverage, the activity, and applicable exceptions.

You can make a request using the contact information in Section 15. We consider and act upon requests in accordance with applicable law. We do not treat lawful requests for your own information as demands for Company credentials or another person’s confidential information.

Where the relevant law applies, you may complain to a supervisory authority or regulator. Information is available through the European Data Protection Board’s authority directory, the UK Information Commissioner’s Office, the Swiss Federal Data Protection and Information Commissioner, and the Office of the Privacy Commissioner of Canada. You may also contact the competent U.S. state regulator.

If we rely on consent to process personal information, you may withdraw it by contacting us. Withdrawal does not affect processing that was lawful before withdrawal or processing that may continue on another lawful basis where permitted. It may affect a feature that cannot lawfully or practically be provided without the necessary information, subject to any legally required alternative or accommodation.

A request to withdraw biometric consent is not automatically a request to erase every transaction document. We address the relevant processing, associated records, and lawful retention separately. Identity and authority still must be adequately verified before a listing is activated; applicable limits on refusing service or requirements for review remain in effect.

Opting out of marketing and promotional communications

You can unsubscribe from promotional email using the unsubscribe link, reply STOP to opt out of texts, or contact support@fsbomlslistings.com. We may retain a limited record of an opt-out so that it can be respected.

We may still need to communicate about an account, listing, transaction, privacy request, or other non-marketing matter, but only through a legally permitted channel. Describing a message as service-related does not override an effective consent withdrawal where consent is required. Contact us to discuss an appropriate available communication method.

Account information

To review or change account information or request termination, you can:

  • Contact us using the information in Section 15.
  • Log in to the customer dashboard and use the available account functions.

Upon a termination request, we deactivate or delete the account and relevant information from active systems as appropriate, subject to lawful retention. We may retain information needed to prevent fraud, address disputes or investigations, maintain required records, or meet other legal obligations. The retention discussion in Section 7 applies.

Cookies and similar technologies

Most browsers allow you to remove or reject cookies and manage site storage. Blocking cookies can affect some features. A browser setting does not necessarily stop every tracking request or exercise all legal opt-out rights. Provider-specific advertising settings may provide additional choices for those providers; they do not replace any controls or responses required of Home Sold Realty.

See Sections 5 and 11 for the current website disclosures and Sections 12–13 for applicable regional rights. Email our privacy contact with questions or requests concerning advertising-related processing. We do not require a new paid account or a new biometric verification merely to submit a privacy request.

Review of decisions and other U.S. state rights

Where applicable law gives you a right to challenge or obtain review of a decision, restrict sensitive-data use, appeal a refusal, or opt out of specified automated processing, contact us in writing. We explain the relevant response and any applicable exception. A failed identity check alone is not a determination that the individual committed fraud.

States beyond California and Virginia may provide privacy rights. The separate sections below are retained for their detailed explanations, not as a statement that no other state’s protections apply. We do not unlawfully discriminate against individuals for exercising privacy rights.

11. CONTROLS FOR DO-NOT-TRACK FEATURES

Some browsers and devices provide a legacy Do Not Track (DNT) setting intended to communicate a preference about online tracking. DNT is distinct from legally recognized opt-out preference signals, including Global Privacy Control (GPC). We do not represent that a DNT setting stops our site’s collection of information.

Global Privacy Control and other legally recognized signals are separate from legacy Do Not Track settings. Automatic GPC handling has not been verified in our current website configuration. You may also send privacy requests to support@fsbomlslistings.com. This limitation does not waive any right to use a recognized opt-out signal or replace a legally required technical response with an email-only process.

We update this notice and the relevant disclosures when our practices or applicable requirements change. See Sections 5 and 12 for related information.

12. DO CALIFORNIA RESIDENTS HAVE SPECIFIC PRIVACY RIGHTS?

In Short: California residents may have specific rights. The rights and duties described below apply where the relevant California law covers Home Sold Realty and the information involved.

California direct-marketing and minor-content provisions

California Civil Code Section 1798.83, commonly called the Shine the Light law, permits eligible California residents to request certain information about disclosure of personal information to third parties for those parties’ direct-marketing purposes. Where applicable, you may make the permitted annual request without charge by writing to us. Property-inquiry contact sharing and permission-based referrals are described separately in Section 4.

If you are under 18, reside in California, and have posted content through an account despite our adult-only account policy, you may request removal of publicly posted content where California law provides that right. Include enough information to locate the content and associated account. Removal from public display may not eliminate every independent copy or lawfully retained backup. This does not authorize registration by minors.

CCPA Privacy Notice

For this section, “CCPA” means the California Consumer Privacy Act, as amended. A California resident generally includes an individual in California for other than a temporary or transitory purpose, and an individual domiciled in California who is temporarily outside the state. Other individuals are nonresidents for these provisions.

Residence alone does not establish that every CCPA provision applies to every business or data category. Coverage thresholds, exemptions, and the nature of the processing must also be considered. The disclosures and rights below apply to the extent the CCPA covers the relevant activity.

What categories of personal information do we collect?

The categories below describe our known current listing-service practices. Examples may overlap and do not mean every customer supplies every item. The table is not a representation that all historical screening records or every advertising transfer during the preceding 12 months have been inventoried.

CategoryRelevant examplesCurrent practice
A. IdentifiersNames; contact details; IP addressesCollected
B. Customer recordsSignatures; account and transaction recordsCollected
C. Protected characteristicsBirth date; other incidental ID detailsMay appear in ID records
D. Commercial informationOrders; payment status; purchase historyCollected
E. Biometric informationFacial measurements or templatesProcessed through Veriff
F. Internet/network activityWebsite activity; device/session informationCollected
G. GeolocationApproximate location from IPApproximate; no verified GPS use
H. Audio/visual informationID images; selfies; recorded callsCollected
I. Professional informationBusiness representatives; entity authorityWhere relevant to listing
J. Education informationStudent recordsNot routinely requested
K. InferencesIdentity-check and verification resultsRelevant results processed
L. Sensitive informationGovernment IDs; credentials; facial biometricsProcessed as described

Current ownership verification is not tenant screening. Any remaining historical SARMA records may involve additional financial, creditworthiness, employment, or other application information. Their presence, retention, and any applicable historical disclosures must be addressed according to the actual records.

We may also receive personal information when you seek support, take part in a survey or event where offered, or provide information needed to deliver Services. Such an interaction does not authorize an undisclosed use or mean that every category listed above is collected in that interaction.

How do we use and share your personal information?

Sections 1–4 describe the sources, purposes, and categories of recipients. Identifiers and account/commercial records are used for account administration, orders, listings, communication, and records. Government-ID, biometric, and verification information are used for identity and fraud-related processing, not for public listings or advertising. Audio/visual and technical information support the respective communication, verification, security, or website function.

Information is retained according to the category and purpose described in Section 7, rather than solely for as long as an account remains open. Categories disclosed for a business purpose depend on the activity and recipient; ordinary service providers do not receive all sensitive records simply because they support our business.

For a request concerning categories or specific information collected, used, or disclosed during a legally required look-back period, contact us as described below. An incomplete historical inventory is not treated as “no collection” or “no disclosure.”

CCPA “sale” and “sharing” have particular legal meanings. Sharing can include disclosure for cross-context behavioral advertising even without a cash payment. Online identifiers and browser, device, or usage information may be disclosed to the analytics and advertising-related providers described in Section 5. Whether a disclosure is a sale, sharing, or qualifying service-provider processing depends on the actual use and arrangement. We do not claim that all such disclosures fall outside sale or sharing merely because we do not distribute customer contact lists to unrelated vendors.

Where the CCPA applies, you may opt out of sale or sharing and use a recognized opt-out preference signal as provided by law. You may email support@fsbomlslistings.com with “Privacy Opt-Out” in the subject. Our websites currently do not display a cookie-preferences banner. A separate “Do Not Sell or Share” control and automatic GPC handling have not been verified. These limitations do not restrict rights or substitute for controls required by applicable law.

Appropriate processing by a qualifying service provider under the required restrictions is distinct from unrestricted sharing with an independent business. Similarly, describing an activity as internal research or service development does not itself determine whether a disclosure is a sale or sharing. A provider’s label or privacy notice does not settle the Company’s own classification.

Your rights with respect to your personal data

Right to request deletion. You can ask us to delete personal information, subject to exceptions allowed by law. These may include required transaction records, exercising or defending legal claims, protecting against unlawful activity, and other applicable exceptions. Where required, we also notify relevant providers or recipients. We explain applicable retained categories and reasons rather than treating all records as automatically exempt.

Right to know and obtain a copy. Depending on the request and applicable law, you may ask about:

  • Whether and how we collect and use your personal information.
  • The categories and specific pieces of personal information collected.
  • The categories of sources from which we obtained it.
  • The purposes for collection, use, disclosure, sale, or sharing.
  • Whether we sell or share personal information and the relevant categories.
  • The categories of third parties receiving information and the categories disclosed to them for the relevant purposes.

Information and copies are provided subject to applicable safeguards and exceptions. We are not required to re-identify genuinely de-identified information solely to respond where the law does not require it. We do not disclose another person’s private information or Company credentials to fulfill your request.

Right to correct. You may request correction of inaccurate personal information, taking account of the nature of the information and the processing purpose. A request concerning a provider-controlled or independent public record may also need to be directed to that source, without removing our duties concerning our own records.

Right to opt out of sale or sharing. You may direct covered processing to stop as described above. Opt-out requests generally do not require the identity-verification process used for requests for specific information. We may ask only for information reasonably necessary and legally permitted to apply the request.

Right to non-discrimination. We do not unlawfully discriminate against you for exercising privacy rights. A necessary service-related limitation is assessed under applicable law rather than used to penalize a lawful privacy request.

Right to limit use and disclosure of sensitive personal information

Where this right applies, you may direct us to limit sensitive information to uses permitted by law, including information reasonably necessary to provide requested Services and other permitted purposes. Examples of legally defined sensitive information can include:

  • Social Security, driver’s license, state-ID, and passport numbers.
  • Account logins or financial account details together with credentials permitting account access.
  • Precise geolocation.
  • Contents of mail, email, and texts where the business is not the intended recipient.
  • Racial or ethnic origin, religious or philosophical beliefs, and union membership.
  • Genetic information, qualifying biometric identification information, and health information.
  • Information concerning sex life or sexual orientation.

These statutory examples do not mean we collect every listed category. Our actual collection is described in Section 1. The limitation right has exceptions, including relevant rules for information not processed to infer characteristics, and publicly available or otherwise exempt information. We will explain the applicable scope rather than assume every sensitive-data use can continue unchanged or must cease entirely.

To exercise a limitation right, email support@fsbomlslistings.com with “Limit Sensitive Information” in the subject, or use another applicable contact method in Section 15. We do not use biometric identifiers or biometric information for advertising, sale, lease, or trade.

Verification process

For requests requiring identity or authority verification, we use information reasonably needed to establish that you are entitled to make the request. For example, we may match existing account information or contact you through an address or number already on file. We avoid collecting additional sensitive information where a less intrusive method is sufficient. A privacy request does not automatically require another Veriff session.

Information obtained to verify a request is used for that purpose and relevant security or compliance needs, not unrelated marketing. We retain only the request and verification evidence needed for an applicable lawful purpose, and handle additional information under the appropriate retention requirements. We do not promise immediate deletion of records that applicable law requires us to keep.

Authorized agents, responses, and other privacy rights

You may authorize an agent to submit a request where permitted by law. We may require legally permitted proof of authorization and, for some requests, direct confirmation from you. We do not impose proof requirements beyond what the request and applicable law allow.

Covered requests to know, correct, or delete generally receive a response within 45 days, with a permitted additional 45 days where needed and timely explained. Sale/sharing opt-out and sensitive-information limitation requests can have different deadlines; we apply the relevant deadline rather than a universal 45-day period.

You may object to or ask us to restrict processing where applicable law gives that right. You may also raise a complaint with us or the relevant California regulator. Contact methods appear in Section 15. The privacy email and mailing address remain available without creating an account.

13. DO VIRGINIA RESIDENTS HAVE SPECIFIC PRIVACY RIGHTS?

In Short: Virginia residents may have rights under the Virginia Consumer Data Protection Act (CDPA) where the law covers the relevant processing.

Virginia CDPA Privacy Notice

Under the CDPA:

Consumer means a natural person who is a Virginia resident acting in an individual or household context, not a commercial or employment context.

Personal data means information linked or reasonably linkable to an identified or identifiable natural person, subject to the statute’s exclusions for de-identified and publicly available information.

Sale of personal data means exchange of personal data for monetary consideration, subject to the statutory exclusions. This definition is not identical to every other state’s definition.

Rights and obligations depend on applicable coverage and exemptions, not residence alone. Our information practices vary with the Services and are explained in Section 1, Section 2, and Section 4.

Your rights with respect to your personal data

Where the CDPA applies, you may have the right to:

  • Confirm whether we process your personal data and access it.
  • Correct inaccuracies, considering the nature of the data and processing purpose.
  • Request deletion of personal data provided by or obtained about you, subject to exceptions.
  • Obtain a portable copy of qualifying data you previously provided, where technically feasible and required.
  • Opt out of targeted advertising, sale of personal data, or profiling in furtherance of decisions producing legal or similarly significant effects, as defined by the law.

We do not intentionally distribute your designated contact information to vendors for unrelated solicitation. However, because property inquirers are not independently authenticated, we cannot guarantee that a person requesting property information will use the contact details solely for that purpose. That Company practice does not replace a separate assessment of statutory sale, targeted advertising, or other processing. Sections 4 and 5 describe listing-related sharing and website technologies. No unsupported promise about all future provider practices is made.

Exercise your rights provided under the Virginia CDPA

Submit a request to support@fsbomlslistings.com, through the dashboard support widget, or by mail using Section 15. An active customer account is not required for email or mail. Where an authorized representative may act under applicable law, provide sufficient lawful evidence of authority; we do not demand unnecessary personal information.

We may request additional information reasonably necessary to authenticate a request that requires authentication. We use it for the request and associated lawful security or recordkeeping purposes, not unrelated marketing. We explain when we cannot reasonably authenticate a request rather than releasing information to an unauthorized person.

For covered requests, we respond without undue delay and within 45 days of receipt. The period may be extended once by another 45 days when reasonably necessary; we notify you during the initial period and explain the reason. Where permitted by law, exceptions or limitations may apply, and we explain a refusal and applicable appeal instructions.

Right to appeal

If we decline a covered request, you may appeal by emailing support@fsbomlslistings.com with “Privacy Appeal” in the subject and identifying the request. Within 60 days of receiving a covered appeal, we inform you in writing of the action taken or not taken and the reasons. If the appeal is denied, you may contact the Virginia Attorney General’s consumer-protection office to submit a complaint.

These procedures do not limit rights under other laws or authorize retaining, collecting, or using information in a way those laws prohibit.

14. DO WE MAKE UPDATES TO THIS NOTICE?

In Short: Yes. We update this notice when our practices or relevant requirements change.

The updated version will be indicated by a revised “Last updated” date and any applicable effective-date information. If we make material changes, we provide additional notice where required, such as a prominent website notice or direct communication. We obtain new consent when the changed processing requires it; continued use is not a substitute for legally required affirmative consent.

Please review this notice periodically. Providers maintain their own notices linked in Section 4. A provider changing its notice does not, by itself, authorize Home Sold Realty to use your information for a new, undisclosed purpose or remove our own legal responsibilities.

15. HOW CAN YOU CONTACT US ABOUT THIS NOTICE?

If you have questions or comments about this notice, or wish to make a privacy request, contact:

HOME SOLD REALTY LLC — Privacy Requests
4781 N Congress Ave, #156
Boynton Beach, FL 33426
United States

Email: support@fsbomlslistings.com
Dashboard: Customer dashboard and support widget

Privacy requests are handled in writing through these channels. You do not need an active account to email or write to us. Include enough information to identify the interaction and request, but do not send passwords, verification codes, unredacted ID images, or unnecessary sensitive data. Where applicable law requires an additional request method, that requirement is not restricted by the Company’s ordinary technical-support policy.

16. HOW CAN YOU REVIEW, UPDATE, OR DELETE THE DATA WE COLLECT FROM YOU?

Based on applicable law, you may have the right to request access to personal information we collect, obtain a copy, correct it, or request deletion. To make a request, email support@fsbomlslistings.com, use the dashboard support widget, or write to the address in Section 15. The detailed rights, identity/authority checks, response periods, and exceptions in Sections 7 and 10–13 apply.

Describe the information or interaction concerned and the action requested. We verify identity or authority only as reasonably necessary and legally permitted, locate relevant records, and address the request under the applicable requirements. We may retain information that must lawfully be preserved and explain relevant exceptions. Requests involving Veriff verification are coordinated through Home Sold Realty for information processed on our behalf; independently controlled provider information may also require that provider’s response.

Requesting account closure does not automatically cancel a listing agreement, erase a completed transaction, or remove independent MLS or third-party historical records. Those matters are addressed under the applicable agreement and legal requirements, without removing your rights concerning information under our control.
